Former trucker lands in prison after cops seize trailer full of narcotics

MCALLEN, Texas — U.S. Attorney Alamdar S. Hamdani recently announced that former truck driver Daren Lynn Lopez, 51, of Edinburg, Texas, has been sentenced after his March 2022 conviction of conspiracy to possess with intent to distribute 440 pounds of methamphetamine. The narcotics were seized by law enforcement and later found to have an estimated street value of $1 million, according to a news release. After learning of Lopez’s lengthy criminal history, which included three prior felonies, U.S. District Chief Judge Randy Crane sentenced Lopez to 16 years in federal prison. After his sentence, Lopez will serve three years of supervised release. At the time of the crime, authorities say Lopez arranged for the transportation of a tractor-trailer concealing the 440 pounds of meth. Once he successfully entered the United States, Lopez drove the trailer to his yard in Edinburg. He then coordinated with and hired a driver who would transport the trailer to Dallas. However, law enforcement intervened, stopped and seized the trailer. When they searched the it, they found a false compartment that covered the entirety of the trailer’s roof, which held hundreds of meth bricks.  Following his sentencing, Lopez will remain in custody while waiting to be transferred to a U.S. Bureau of Prisons facility. The Drug Enforcement Administration conducted the investigation, and Assistant U.S. Attorney Laura Garcia prosecuted the case.

Man jailed for involvement in drug ring that used semi to transport narcotics

COLUMBUS, Ohio — The last of 11 defendants convicted of crimes as part of a national narcotics distribution operation bringing drugs into Central Ohio from California was sentenced in U.S. District Court in early March. Co-defendant Justin M. Berrien, 44, of Springfield, Ohio, was sentenced to just over five years in prison. The organization, led by Isabel Odir Castellanos of Los Angeles, involved more than 160 pounds of fentanyl, the forfeiture of seven firearms and vehicles and nearly $650,000 in cash. For her role in the organization, Castellanos was sentenced to 21 years in prison. According to court documents, Castellanos transported narcotics from Los Angeles to Columbus, Ohio, via semi-truck. Castellanos was the owner of a transportation company and a semi-truck driver who frequently traveled across the United States. Authorities said Castellanos was the one who delivered the narcotics to a co-defendant’s residence in Columbus, which served as a stash house. Co-conspirators then delivered the drugs to mid-level retail distributors like Berrien. Those mid-level retailers then sold the drugs in Central Ohio, Youngstown, Springfield and West Virginia. Castellanos would then collect the drug proceeds before returning to California. Kenneth L. Parker, United States Attorney for the Southern District of Ohio, and Orville O. Greene, special agent in charge of the Drug Enforcement Administration, announced Berrien’s  sentence, which was imposed by Chief U.S. District Judge Algenon L. Marbley. The U.S. Bureau of Alcohol, Tobacco, Firearms & Explosives, the Ohio Narcotics Intelligence Center, the Ohio State Highway Patrol and the Springfield Police Department assisted in the investigation. Assistant United States Attorney Michael J. Hunter represents the United States in this case. This investigation was conducted as part of an Organized Crime Drug Enforcement Task Force (OCDETF) initiative. OCDETF identifies, disrupts and dismantles criminal organizations that threaten the United States using a prosecutor-led, intelligence-driven, multi-agency approach. Additional information about OCDETF can be found at https://www.justice.gov/OCDETF. The other defendants in this case are listed below.

ALBUQUERQUE, N.M. — Alexander M.M. Uballez, the United States Attorney for the District of New Mexico, and Raul Bujanda, the special agent in charge of the FBI Albuquerque Field office, recently announced that Ryntana Yazzie, an enrolled member of the Navajo Nation, was sentenced to 30 months in prison for an Aug. 4, 2020, drunk driving crash that left trucker John Doe deceased. According to the court documents, Yazzie, of Crownpoint, New Mexico, was driving south on Highway 371 outside of Farmington, New Mexico, when her vehicle veered into oncoming traffic and struck a semi-truck driven by Doe, who was driving northbound. Authorities said that Doe tried to swerve to avoid the collision, causing the impact to be head-on. Doe was declared deceased at the scene after suffering blunt force trauma in the head and neck areas, causing hemorrhaging. Yazzie sustained a broken left arm and a broken leg.  The Farmington Resident Agency of the FBI Albuquerque Field Office investigated this case with assistance from the Navajo Nation Department of Investigation, the Department of Criminal Investigations, and the New Mexico State Police. Assistant United States Attorney Nicholas J. Marshall is prosecuting the case. It was also stated that upon her release from prison, Yazzie would be subject to three years of supervised release.

Michigan man found guilty of setting fires to Swift trailers

RIVERSIDE, Calif. — On Tuesday, Mar. 12, an Allen Park, Michigan, man was found guilty of setting fires to six truck trailers that belonged to commercial trucking company Swift Transportation. His crime spanned 10 months, according to officials. A jury found Viorel Pricop, 66, guilty of six counts of arson of vehicle or property in interstate commerce after being held in federal custody since October 2022. From December. 2021 to September 2022, Pricop “maliciously set fire to six semi-trailers belonging to Swift Transportation,” a news release states. “Four of those arsons occurred in San Bernardino County (Newberry Springs, Ludlow, Barstow and Hesperia), and two happened in Riverside County (Coachella) in California.” According to an affidavit that was filed previously in this case, Pricop also set fire to at least 18 additional Swift Transportation semi-trailers in other states from June 2020 to March 2022. These incidents occurred at locations spanning from Barstow, California, to McCalla, Alabama, with most incidents occurring along Interstate 10 and Interstate 40. Federal criminal charges associated with some of these fires were filed against Pricop in the District of New Mexico and the District of Arizona. “We have methodically worked each of the fire scenes, collected evidence, interviewed witnesses and reviewed video footage to help us solve these arson cases,” said Special Agent in Charge Brendan Iber of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Phoenix Field Division. “ATF’s certified fire investigators will continue to enforce federal laws pertaining to arson and support our state and local police and fire investigators.” Swift Transportation hired a fire investigation consultant who assisted with the fire scene examinations. While investigating, a pattern began to develop when multiple reports noted similar methods of lighting the trailers on fire, including where on the vehicles the fires started and the fact that they occurred during the middle of the night. In each of the incidents, the Swift-owned trailer was parked at or near a truck stop when a fire occurred on the trailer portion of the 18-wheeler, mainly on or near the trailer tires. “Since beginning the work to solve this case, our arson investigators did a great job of looking at each fire to put the pieces together,” said New Mexico State Fire Marshal Randy Varela. “We know how important our partnerships with other agencies are, especially with a case that spans across multiple states, and we are proud of the work that we were able to do together to catch this arsonist.” Law enforcement officials were able link Pricop to the fire scenes after reviewing cell tower data that was transmitted from a navigation device in his truck. After obtaining court authorization, law enforcement was also able to obtain data and real-time location information from Pricop’s cellphone. Analysis of this information determined that Pricop was indeed present in the areas around all of the California fires as well, as the 18 fires in other states. In September 2022, search warrants were executed on Pricop’s tractor-trailer, personal vehicle and residence, yielding additional evidence corroborating his involvement in this series of arsons. The evidence collected included a gas torch, torch-style lighters and record-keeping documents containing location information, such as cargo pickup and delivery dates, which coincided with the time and location of several fires in the series of 24 fires across the country. United States District Judge Sunshine S. Sykes has scheduled Pricop’s sentencing hearing for June 7. At that time, Pricop will face a mandatory minimum sentence of five years in federal prison and a statutory maximum of 20 years in federal prison for each count. Assistant United States Attorneys Cory L. Burleson, Sean D. Peterson and Mitchell M. Suliman of the Riverside Branch Office are prosecuting this case.

MEMPHIS, Tenn. — FedEx Corporation reports that Robert B. Carter will remain with the company as a senior advisor until Dec. 31 to help ensure a successful transition, according to a news release. “Carter spearheaded cutting-edge technology that differentiated FedEx in the industry, such as real-time tracking and transactions,” the news release states. “When the Internet became more popular in the 1980s and 1990s, he recognized the power behind these transactions. He knew how to play an instrumental role in launching tools to provide customers with visibility into that data.” Raj Subramaniam, president and CEO of FedEx, praised Carter’s abilities. “Rob has had a distinguished career at FedEx, most recently leading FedEx in modernizing our IT infrastructure for our network that ships 15 million packages per day around the globe,” Subramaniam said. “I am immensely grateful to Rob for his numerous contributions in establishing FedEx as an innovative, data-driven and people-focused company and wish him all the best in his well-deserved retirement.” Effective July 1, Sriram Krishnasamy, the current executive vice president and chief transformation officer for FedEx Corporation and the president and CEO of FedEx Dataworks, will begin his tenure as chief digital and information officer. ITS Logistics March Index: ILA negotiations makes list of concerns for ’24

RENO, Nevada — ITS Logistics’ March forecast for the ITS Logistics US Port/Rail Ramp Freight Index reveals the most significant supply chain concerns over the next 12 months, including trucking capacity exiting the market and container supply chains at risk due to diversions around Red Sea avoidance effects. In addition, as Q2 approaches, the index will closely follow the International Longshoremen Association (ILA) negotiations as current ocean contracts are being deliberated, according to a news release. “As we navigate ocean carrier RFP (requests for proposals) season this month, it is important to strategically plan your supply chain for the next 12 months,” said Paul Brashier, vice president of Drayage and Intermodal for ITS Logistics. “It is critical to stay as geographically close to your trucking capacity as possible. If you can book to the ramp/port or, to the door while utilizing customer nominated trucker (CNT) commercial arrangements, you can ensure that trucking capacity is properly vetted and that you have trusted partners with a nationwide footprint.” Since no significant traction has been made to date in the ILA negotiations, this has sparked a cause for concern across the industry. Overall, tactical hedging to the west is a strategy to keep in mind, and the ILA’s six-year contract with the United States Maritime Alliance expires Sept. 31. It represents port terminal operators and ocean carriers on the East Coast. “The union has confirmed May 17 as the cutoff date for the local contracts to be agreed to in order to implement the negotiation of a master contract for the largest union of port workers in North America,” Brashier said. “Despite the fact that historically, the ILA has cautioned against striking in comparison to West Coast union counterparts, contingency plans should be put in place during this current ocean contract season.” According to recent CNBC coverage, logistics managers are moving more freight away from the East Coast. This is co-occurring with trade being rerouted due to the Panama Canal drought restrictions and Red Sea diversions. Cargo containers that were once set to be shipped to the East Coast are now beginning to be sent back to the West Coast. The goal is to avoid service disruptions, which is the reverse of what occurred in 2022 and 2023, according to ITS. Negotiations for the six-year contract officially began last month. While the future is currently uncertain, ITS urges professionals to proactively prepare for any disruptions resulting from the current negotiation climate. ITS Logistics offers a full suite of network transportation solutions across North America and omnichannel distribution and fulfillment services to 95% of the U.S. population within two days. These services include drayage and intermodal in 22 coastal ports and 30 rail ramps, a full suite of asset and asset-lite transportation solutions, omnichannel distribution and fulfillment, and outbound small parcels. CARB requirements for Clean Truck Check on-board diagnostics coming soon

SACRAMENTO, Calif. — The California Air Resources Board (CARB) will soon begin phasing in the On-Board Diagnostic (OBD) Monitor Readiness and Permanent Diagnostic Trouble Code (PDTC) requirements as part of Clean Truck Check. An exact date has not been announced, but CARB officials state that it will be “in early 2024.” “Readiness is determined by how many OBD system diagnostics have been completed and the number of vehicle operations since codes were cleared (OSC – Operation Since Clear),” a news release states. “The OBD system diagnostics are broken down into categories called ‘Monitors.’ Each Monitor must undergo diagnostic tests to determine whether those systems work correctly. The OBD system reports whether each Monitor has had time to complete its tests; if so, the Monitor is considered “Ready.”  Monitors’ specific numbers and types vary based on OBD protocol (J1939 vs. J1979), fuel type, vehicle make and model year. Based on the tests performed, most vehicles have all Monitors ready when compliance tests are submitted. The OBD systems store information regarding vehicle operation since codes were cleared. Most vehicles have OSC for one or more reasons: Warm-up cycles (WUCs) since clear Distance traveled, in km, since clear Engine run time, in minutes, since clear Typically, vehicles can track WUCs in either minutes or distance since they are clear. The criteria will be applied to the OSC variables provided by an individual vehicle. As the requirements are phased in the thresholds for these variables will become more stringent over time. Permanent diagnostic trouble codes (PDTCs) are very similar to regular diagnostic trouble codes (DTCs). The only difference is that they cannot be reset by disconnecting the vehicle’s battery or cleared using an OBD scan device like how regular DTCs can. The only way to clear a PDTC is to fix the underlying problem with the car that initially activated the PDTC, and then allow the vehicle sufficient drive time to re-run the Monitor that identified the problem in the first place. When the Monitor runs without identifying a problem, the PDTC will clear itself. Things to do to have your best chance at passing the Clean Truck Check OBD test include: Getting your vehicle repaired as soon as your malfunction indicator lamp (right) is on, get your vehicle repaired as soon as possible Doing the OBD test early in the Clean Truck Check compliance window so you will have time to complete it if there are problems Avoid code clearing — OBD systems require substantial vehicle operation to complete their emission control diagnostic tests, and a vehicle that has not been operated enough or has too many monitors incomplete will fail the test Code clearing can occur when: Disconnecting the battery Using an improperly installed kill switch that disconnects power to the OBD system [it is OK if the kill switch just cuts power to accessories/lights/etc.] Using an OBD scan device to clear codes For more information, visit https://ww2.arb.ca.gov/obd-readiness-criteria.

Bendix team members volunteered close to 9,500 service hours to company-sponsored volunteer events or through personal endeavors, an increase of close to 10% from 2022, according to a news release.  “Our community support efforts are firmly rooted in our culture,” said Maria Gutierrez, Bendix senior director of environmental, social, and governance, noting that employee participation numbers are once again up 10% from the previous year. “Employees across the organization dedicated more volunteer hours to more projects in more ways. It shows that our community support efforts are not one-off events but are part of who we are as an organization.” In 2023, Bendix employees gave approximately $492,000 in grants, donations, employee fundraisers and Dollars for Doers incentives from the company and its employees to multiple diverse nonprofit organizations and community initiatives in the areas where Bendix operates in North America. The Dollars for Doers incentives reward employees who volunteer with nonprofit organizations of their choosing.  “Bendix’s philosophy of corporate responsibility centers on social cohesion, underserved youth and families in its communities,” the news release states. “This support prioritizes projects linked to four focus areas: education, the environment, health and wellness and social issues. It takes the form of financial support through grants, fundraisers, donations and volunteer efforts from employees across the company’s North American locations.” In addition to its local outreach efforts, Bendix provided ground-level support for the corporate mission of Knorr-Bremse Global Care North America Inc.
